Terms of use & Terms and Conditions

The following Terms & Conditions is a legal contract between a client and DexPress Interpreting ltd.

Welcome to the website of DexPress Interpreting. By accessing our site, you agree to these Terms and Conditions of Use and are bound by all applicable laws and regulations.

The site and its original content, features, and services are owned by DexPress Interpreting and are protected by international copyright, trademark, intellectual property, and other proprietary rights laws.

If, for any reason, we believe that our Terms and Conditions have not been upheld, we reserve the right to suspend or terminate access to our website or/and services without prior notice or liability.

An ‘Interpreter’ is the person who performs the act of interpreting spoken or signed communication into another language at an N.R.C.P.D. (National Registered of Communication Professional for Deaf people) R.S.L.I. (Registered Sign Language Interpreter) standard.

‘Client’ shall means the party or intermediary engaging the services of the Interpreter and having responsibility for his/her remuneration. ‘Assignment’ shall means any period or set of consecutive periods of interpreting for one specific purpose or event. 


‘Circumstances’ shall mean any circumstances deriving from any cause, which is beyond the control of the Interpreter or the client.

  

‘Interpreting service provided’ shall mean that an interpreter sent by DexPress Interpreting will provide BSL-English Interpreting to the highest standards strongly following the professional code of ethics set up by the regulating body NRCPD. 

The service shall be agreed in writing at the time when an assignment is accepted and/or those specified in these Terms and Conditions of Business. 

No any additional services shall be added without an express agreement confirmed in writing.

Contracts

All assignments shall be confirmed by a written contract between the Client and a DexPress Interpreting which shall include these Terms and Conditions and any variants explicitly agreed. 

Following the initial verbal/written agreement, it is essential that the Interpreter receive a formal booking form to complete the booking process and obtain full confirmation from DexPress.

In the event there is no time to enter into a written contract, the assignment shall be entered into on the basis of an oral contract only and these Terms of and Conditions shall be deemed to apply.

Fees

Where our services have been contracted for in accordance with the above, the Client shall be wholly liable for the remuneration of DexPress Interpreting service, and reimbursement of any expenses incurred in connection with the assignment whether the interpreting services are in fact provided or not.  

Fees and allowances which shall be freely negotiated and agreed prior to the assignment.

DexPress interpreting shall provide the client with a quote & an electronic invoice displaying the breakdown of the fees to ensure transparency.

Invoices shall be paid in full no later than 28 days following receipt of the invoice. 

Late payments may incur administration charge as well as late payment fees. If, in the course of an assignment, it is found that Interpreting/ Communication Support Services will be required for an additional period after the period of work for which the interpreter was initially contracted, the interpreter may at an agreed hourly rate be invited, but not compelled, to: 

1. Continue for a further agreed period on that same day, 

2. Continue for a further agreed period on subsequent days. 

Fees shall be charged on the basis of an hourly rate, subject to a three hour minimum fee as stipulated at the time of the initial booking request. Where an interpreter has been invited to continue for a further period in extension of the initial contract, a supplementary fee shall be paid at an agreed hourly rate. 

Travel Fees shall be added onto the interpreter fees.

Bookings between the hours of 18:00 and 08:00 or at weekends or public holidays will be charged at time and a half/double rates. Where an interpreter is required, from the outset, to work longer than the working day, a supplementary fee shall be negotiated at an agreed hourly rate. In a situation where the interpreter is unable to continue with the assignment for health and safety reasons the interpreter may remove themselves with no obligation.

Travel and Accommodation Arrangements for travel and accommodation shall be the responsibility of either DexPress or the client as agreed before acceptance. Travel arrangements shall ensure that an interpreter arrives at an agreed time before the start of the assignment and does not have to leave prematurely. Where travel arrangements are made by the Client, these shall be such as to ensure that the interpreter arrives sufficiently rested to fulfil the assignment to the expected standard.

Where the travel arrangements are made by DexPress Interpreting, we shall seek to obtain travel and accommodation at a reasonable cost. Such costs include but are not limited to; mileage agreed at time of booking, standard class train tickets, car parking, tolls, accommodation and London public transport. Any expenditure incurred shall be reimbursed to DexPress within 28 days following receipt of invoice.

Cancellation

If an accepted assignment is curtailed or cancelled either wholly or in part, or performance of the assignment is frustrated for reasons, which the Client or the Client’s principal are responsible, the Client shall be liable for payment of a cancellation fee. Any expenditure incurred as agreed in the contract and any additional expenditure incurred as a result of the cancellation shall also be reimbursed.

If, however, at the time of cancellation the Client is able to offer an alternative assignment of a similar type under comparable conditions and circumstances for all or part of the period of the original assignment and DexPress Interpreting deems it to be within our own professional capabilities, the Client’s liability to DexPress Interpreting in respect of cancellation fees shall be reduced by the amount of the fees payable for the alternative assignment. Any cancellation fee payable shall be determined in relation to the time between notification of cancellation and the start date, as follows: 

1) 7 days or less notice - Full Fee payable 2) 8 to 14 days’ notice - Half Fee payable 3) 15 or more days’ notice - No Fee payable

Unavoidable Circumstances

We shall undertake to notify the Client at the earliest possible opportunity if an Interpreter has been prevented from undertaking an assignment or if performance is frustrated by unavoidable circumstances.

In giving such notice DexPress shall relinquish any right to:

1) Remuneration for the uncompleted part of the assignment;

2) The reimbursement of any expenses, except those already irrecoverably incurred, or necessarily incurred in the interpreter return to their normal place of residence by suitable means.

Preparation Materials

Where applicable, the Client shall provide DexPress with relevant information and preparatory materials in the form of background documentation, in good time; preferably, were possible, two weeks in advance of an assignment in order to ensure provision of a quality service. If it is not possible to provide preparatory materials which have been requested, Client shall arrange for a brief discussion meeting either by phone or in person in order for the interpreter to fully understand the nature of the assignment.

Recordings

No record of an Interpreter's work shall be made without prior consent.

Recordings, which are intended for broadcast or publication, may incur an additional fee. 

​

Responsibility and Liability

We shall endeavour to provide an interpreting service to the best of an Interpreter ability, knowledge and belief. No guarantee can be given as to the absolute accuracy of any interpretation. In the event of a dispute or complaint about the work, the liability shall be limited to the value invoiced by DexPress Interpreting Ltd.
